When in a state of co-ownership, the decision to make alterations and repairs is one in which it is necessary, that both parties must have made a common agreement before any changes are made to a property.[1] It should also be noted that in previous cases where exceptional circumstances arise and the property is in need of necessary repairs that any one of the co-owners is able to make changes to the property.[2]. This can be determined by firstly and very basically establishing that they are in a co ownership,[3] and also that the case provided sees changes made to the property are not repairs as defined as necessary operations in rebuilding, repairing.[4] This means a unanimous agreement was therefore necessary and that the only other way Victor would be entitled to make the changes are seen in Rafique v Amin in which personal bar is referred which would only be relevant if Jack already knew about the changes that were going to be made but chose to do nothing as even though no agreement was reached yet no objection was made. It should also be noted that unauthorised actions will become subject to an interdict. This would prevent Victor from carrying out any more alterations to the property. This does seem to then favour division of the property which would prevent sale however, in a situation where it is seen as far from practical or grossly unsuitable it will end in the sale of a property.[16] This is very much so relevant to issues involving common property that cannot be sold at all such as a commonly used stairwell,[17] or that the co-owners are married in which case would have separate rules or that one of the co-owners has been sequestrated, both are irrelevant to Jack and Victor.[18] It is even possible that it is not sold on the market and that Jack can ask Victor to transfer his share of the of the property to him for half its value, however this is the right to buy out is a contentious one but entirely plausible. It seems therefore, that there is very little Victor can do to prevent Jack from selling the flat. iV. As said previously situations in which property is sold is entirely different for married couples as they follow a separate set of rules regarding the sale of property between co owners. In Jack and Victors current situation at common law both cohabitants initially had no legally recognised status. Although unmarried separation rights are the exact same in property terms when the relationship breaks down it is then they are both distinguishable. The lessee must be given possession of the property and unless in special cases such as shooting rights which can be leased although this must be clarified so the subject of the lease is found.[23] Rent is another which is usual paid periodically and in most circumstance on a monthly basis but can be paid in various different ways such as through services and not only through money.[24] The court may also find a lease exists as long as the other three elements are found.[25] Finally for a lease to be valid there has to be a duration on the lease. So in theory it is allowed for a lease to last for many years.[26] So far it can easily be established that both Navid and Isa have a valid lease in place. Furthermore, the formality of whether or not the lease was signed is irrelevant if the lease lasts one year or less, and longer and both parties must have a written agreement.[27] So, if Navid has entered into a lease for over with Isa for it to be valid it is hoped that there was a written agreement in place along with the other four elements listed above. In most cases a lease will contain the rights of both the tenant and the landlord. This is because the lease is recognised by the law with its own set of terms. The first is possession and that the landlord is obligated (so in this case Isa) to give the tenant what is known as natural possession, one that the landlord should not interfere with.[28] The tenant as a consequence must be present in the property with only short absences allowed as without such a possession of the property the lease can be regarded as a material breach such as when a tenant was absent from a prison due to detention in prison.[29] The second reason is that rent must be paid by the tenant when it is due. The reason leases are so short and are often changed is due to changes in external factors such as inflation, if the new rate set is not agreed on it is for the third party to decide, which will see the rent set in line with market rates. Thirdly, the property must be sufficiently plenished by the landlord to a reasonable standard in which it would be expected to be equitable for the payment of rent, as without this an interdict can be put in place against the land lord.[30] The tenant is also obligated to use the property for the purposes of let and may not alter or invert this which will cause a breach of the lease, however, The Landlord is obliged to make sure that the property in question is fit for the circumstances under in which it will be let, which can lead Isa to be questioned on her upkeep of her property. Finally, the property must be maintained by the landlord, so the landlord must carry out the maintenance to the property within a reasonable time and if he does not he is liable.[31] The landlord however is not liable if an Act of God occurs such as a flood, a third party causes damage ( in which case they are liable) or the tenant will be liable if they breach the obligation to take care of a property in which case they will be made to pay. There are reasons for either Landlord or tenant in this situation to bring the lease to an end. Firstly, Isa could feel the need for the lease to end due to the fact Navid has not paid rent for the past 6 months. This is a clear obligation of a lease, and the onus is very much on Navid to pay that money. Without Navid paying that money it can be cause for Isa to take action against Navid the remedies available include what is known as action for payment. This remedy is typically used for situations including this one in which rent is not paid, this results in the execution of the lease which is often found as a clause within the lease. This enables a judge to carry out what is known as summary diligence which sometimes does not even need court action.[32] Isa is also entitled to rescind the lease due to a material breach of a monetary obligation in which it would require her to give Navid a 14 day notice to pay the unpaid rent. Furthermore, Isa herself as a landlord has a right to th e goods brought into the property by the tenant known as invecta et illata for rent. It however, seems Navid has the stronger case as Isa has quite clearly fell short of providing a suitable standard of property due to the dampness that has ruined Navids stock. This entitles him to either; seek damages for the fact the landlord has failed to carry out the required repairs that will leed to Navid suffering monetary loss although defining the quantification of such a breach is difficult to determine. He is also able to seek the remedy of specific implement which sees the landlord required by the courts to carry out repairs on Navids shop. This is a remedy specific to Scottish courts which unlike England do not offer such a remedy to the keep open clause. A final option for Navid is to keep suspending his obligation to pay rent due to Isa breaching her obligation to repair the dampness on the premises as he is very much allowed to continue to retain the rent from Isa as long as he has not been paying her for months when she has been failing to meet her obligations. Some of these techniques are better with one model while not better with the representation of the other one. Two most important techniques for representation of model simulation are known as Activity Cycle Diagram and the Condition specification. The activity cycle diagram (ACD) has been used an ideal technique to represent a model. The technique is based on Tochers idea of stochastic gearwheels (quoted in Paul et al 1993. The ACD represents the activities of a model with its entities by composing their life cycles. The entity could be a passive state as Queue or an active state as activity. The Queue and activity are represented in ACD with specific symbols. Part A Specification of the model domain A part enters a cell where it is first loaded onto machine 1. After this operation the part is either loaded immediately on to machine 2, or if that machine is busy, it is moved to a buffer area. After the operation on machine 2, the part leaves the system. All movements are carried out by a robot. The entities in the system and their possible states. Robots are the elements of ACD that introduce parts into machines. It is assumed that there are two Robots. Robot 1 introduce part into machine one and then it has two choices. It moves part from machine 1 to machine 2 if machine 2 is ready to uptake the part. In case the machine 2 is busy, the Robot 1 moves part from machine 1 to buffer zone which is a waiting area. The Robot two is assumed to work with machine 2. It moves part from buffer area into machine 2 when machine 2 becomes available. After processing in machine 2, the Robot 2 moves part from machine 2 to its final position. It should be noted that some assumptions have been made for the responsibilities of two elements (Robots) provided exact tasks have been provided. The Robot 2 has two choices or it will be dealing with two conditions. In condition one when machine 2 is busy, The Robot 2 will not move part from buffer area to machine 2. In condition 2 when machine 2 has become available, then the Robot 2 will move part from buffer zone to machine 2. In the third significant activity, the Robot 2 will move part from machine 2 to its final stage conditional that machine 2 has finished its job on the part. In short, each activity in an ACD is related to one or more conditions. The main attributes of your entities The ACD represents the activities of a model with its entities by composing their life cycles (Abdul et al 1994). The entity could be a passive state as Queue or an active state as activity (Sawhney et al 1995). The Queue and activity are represented in ACD with specific symbols (Shi et al 1997). In the current example, there are also two entities. One is the actual activity or the active state like moving Part from machine one to machine 2 and other entity is the passive entity like buffer zone which can be said as the queue. Similarly we can look at the total entities in ACD. In current example, entities are machine 1, machine 2, Part, buffer area, robot. The physical realization of the queues in the system The physical activity diagram presents an obvious picture to observe the queues in the system (Zeigler 1987). The physical realisation of the queues in the current example comes from the buffer zone which is used as a queue in the example. The part has to wait in buffer area when machine 2 is not free. Therefore the buffer are presents a realisation of the physical queue. The outcome parameters to be studied by the model built upon activity cycle diagram. Each model is designed to study certain parameters in the model (Halpin 1977). The simulation even not used primarily for the optimization of parameters is helpful in optimizing the model in joint effort with design analysis and mathematical evaluation. In the current study, the potential parameters which can be a focus of the study may be studying of queues at buffer zone level, Rate of feed at machine 1, rate of part flow from machine 1 to machine 2 and the removal rate of part from machine 2. All these parameters are of quite significance. For example any significant delay at queue (at buffer zone), decrease at the feed rate at machine 1 or delay at removal rate of part at machine 2 can disrupt the Cell function or decrease its efficiency. The kind of simulation experiments that would be performed with the model. In the real world experimentation can be expensive and in manufacturing and production system, many resources may be used in experimentation (McCahill et al 1993). The alternative to expensive experimentation is simulation methods and other analytical methods (Nance et al 1988). Especially computer model simulations may be economical and provide a chance of actual system observation without incurring unacceptable and expensive options (Murata 1989). On the other hand, physical models may not provide a real picture especially where a layout of resources requires examination such as productivity flow (Vanegas et al 1993). In complex and multistage problems, it may become complex to conduct real and physical experimentation (Paulson 1978). Some actions and activities are not even possible in real world such as a process like flow line optimisation where blocking of a system is required but practically very hard to follow (Paulson et al 1987). However, simulation is not an optimisation p rocedure and must be supported with other procedures like design analysis and optimisation. Therefore we can use experiments like optimisation, design analysis, computerisation simulation, manual simulation, and mathematical model analysis. In current example, objective of model will be kept in mind. First of all small models will be built for each entity. Model will be built in phases and each phase will be checked if it is working properly. The model will be made in phases as it is shown in individual ACD examples. The final ACD will be built once the individual ACD for each entity are checked. Each ACD if planned on computer model or manually will be debugged and corrected. Conclusion ACD are actually the significant evaluation of the flow chart design but with additional features of being used in production and manufacturing field by simulation process. Software is used in designing, analysis and simulation process. Each ACD has entities, attributes attached with entities and conditions associated with each activity. ACD is developed by designing individual ACD for each activity separately and then analysis them for correction. The whole model ACD is developed by merging individual ACD. The current assignment has provided a chance to understand the process of ACD development and analysis by working from individual ACD to the ACD of whole model. The freshmen ‘Imports' arrived at Yale on Sunday. It says as much on the blue tee shirts that can be seen all over campus, worn by the Incoming International class of 2018. The international students have arrived a week earlier than their American peers, as a part of OSI (Orientation for International Students), a Yale program designed to make the transition into American culture as easy as possible. The program is certainly a necessity, as last year, non-American scholars made up 18% of Yale's student body, according to a 2014 census by Yale's Office of Institutional Research.Now, some of those students are helping the new ones settle Into the campus and learn about the surroundings. Advances Tendon, a rising sophomore, is an OSI councilor this year. Most celebrities have millions of followers and subscribers, which mean if they post something, it can reach out to millions immediately. CASTLE’S FAMILY RESTAURANT: HRIS NEEDS ASSESSMENT Essay

Introduction Jay Morgan, an Operations and HR Manager for Castle’s Family Restaurant has asked Preston’s HR consulting firm for a HRIS application proposal that will reduce the time spent traveling between the Castle’s Family Restaurants eight restaurants in the northern California area and help him complete his HR tasks in a cost-effective manner while allowing Mr. Morgan to do part of his HR tasks from his office. The following paragraphs provide a business assessment, detailing the type and size of Castle’s Family Restaurant, the identified HR problems, and a HRIS needs assessment. I have concluded with a brief overview and closed with why a HRIS application is the right strategic choice for Castle’s Family Restaurant. Business Assessment Castle’s Family Restaurant is part of the restaurant industry which according to the National Restaurant Association (2013) is now 13.1 million employees strong, and expected to increase 9.8 percent to 14.4 million by 2023. Castle’s Family Restaurant’s mission is to promote customer loyalty by providing outstanding quality, service, cleanliness, and value and to promote employee loyalty through leadership training, promotion, benefits, and rewards. Castle’s Family restaurant currently employee’s approximately 300-340 employees of which 40% is full time; in the eight restaurants owned in the northern California area. Currently Jay Morgan is both operations  manager and HR manager for the eight restaurants in which time and money is spent traveling between the eight restaurants to manually complete each restaurants HR tasks. Sales have shown improvement over the past ten years since Castle’s Family Restaurant opened up their doors, but contin ue to struggle with employee satisfaction that accounts for the increased turnover rates the company has experienced in the past two years. It is the mission of the company to not only satisfy their customers needs but also their employee’s and therefore it is imperative that the necessary means be taken to decrease the increased employee turnover rates. Identified Problems Castle’s Family Restaurant’s concerns over the past two years are with the increased employee turnover rates. Even though sales have increased Castle’s Family Restaurant is concerned with future revenue and profitability, low workplace moral, and deteriorating product and service quality which are negative impacts from high employee turnover rates. In order to reduce turnover rates more attention must be given to employee training, promoting, benefits, and rewards. Right now Mr. Morgan is spending time and money traveling among the eight restaurants in order to manage scheduling, recruiting, hiring, payroll, and answering employee’s questions; leaving little to no time for developing the employee’s. By automating HR tasks Mr. Morgan can travel less, spend less, and have more time developing the employee’s which in turn will reduce employee turnover rates. Scheduling software can help automate the process of assigning the right number of emplo yees to perform the tasks that need to be performed on each workday and during each meal service. Workflow software will aid in the hiring process by allowing applicants to fill out applications online, upload documents, and allow criteria’s to be set weed out prospects. Even though one-on-one training is important, technology can be used to track the development of employees and also be used in ways of training videos and manuals. Automating payroll will reduce the time spent on them and help avoid mistakes that can lead to legal repercussions. Specialized software exists for both payroll calculation and tips reporting; which exist in the restaurant industry. Such software can help Mr. Morgan by automatically calculating payroll while remaining in compliance with the relevant legislation, make it easier to enter payroll data into databases where it  can be searched, and save time that would’ve been wasted on manual calculation. Payroll software can also help with ot her measures such as directly depositing paychecks into employees’ bank accounts. Though, I believe that each HR tasks listed above could benefit the company if automated, it is in the best interest of Mr. Morgan and Castle’s Family Restaurant to automate payroll to reduce errors and compliance issues and also free up some time which can be used for employee development. HRIS Needs Assessment Currently Mr. Morgan uses Excel spreadsheets and a computer application to print payroll checks. He spends on the average eight hours to process payroll for the approximant 300-340 Castle’s Family Restaurant employees. Without schedule software each manager at the eight restaurants have to print weekly schedules and make changes as necessary throughout the week; increasing errors. Mr. Morgan enters the schedules in the Excel spreadsheets which he relies on his knowledge of Excel to make the correct calculations. An automated time keeping system will track employee hours and pay hourly employees accordingly; it will also allow Mr. Morgan to import employee hours into payroll software which will compute the time worked; which saves Mr. Morgan time from having to manually calculate employee’s payments and deductions. Automated payroll is also a record keeper which the â€Å"IRS requires employers to keep employment tax records for a minimum of four years. Furthermore, the U.S. Department of Labor requires payroll records to be kept for at least three years† (Grace, 2014). With a HRIS application Castle’s Family Restaurant can connect all eight restaurants in the northern California area. HRIS will assist Castle’s Family Restaurant in two major areas: recording and recruiting. HRIS will allow the company to invest more time and money in their most valuable resource their employees. Conclusion It is without a doubt that Castle’s Family Restaurant is in need of Automating HR tasks in order to save time and money while keeping their customers and employee’s satisfied; because we all know that if the employee is not happy, neither is the customer. It is my suggestion that payroll be the first HR function to be automated.
